This guidance was laid in Parliament in draft on 21 July 2016 in line with section 59 of the Immigration Act 2016. It set out the principles and process for making decisions on immigration detention, for the purposes of removal, of individuals who are or may be considered at risk.

The guidance came into force on 12 September 2016.

This statutory guidance has now been revised. The revised guidance was laid before Parliament in draft on 21 March 2018. Subject to Parliamentary processes, this will replace the previous guidance and will come into force on 2 July 2018.
